Assimilata al conflitto armato internazionale sotto il profilo della disciplina giuridica è anche l’occupazione militare (occupatio bellica)*(2), ossia la situazione che si viene a creare quando le forze armate di uno dei belligeranti hanno invaso il territorio dell’avversario, estromettendone le truppe e assumendone il controllo in modo effettivo (v. infra, sez. 2.3).
Le regole sui conflitti internazionali si applicano anche alla cd. levata in massa (levée en masse) degli abitanti di un territorio non occupato di cui tratta l’art. 2 del Regolamento dell’Aja sulla guerra terrestre3 :
