Il DICA nasce infatti agli inizi del 1800. Il suo scopo non è quello di eliminare l'uso della forza nelle relazioni internazionali (scopo quest'ultimo che sarà proprio della Comunità internazionale solo dopo il II conflitto mondiale), ma più semplicemente quello di eliminare il più possibile gli abusi nell'uso della forza tra i belligeranti ovvero tutti quei comportamenti che non sono necessari per vincere la guerra ma che si traducono soltanto in sofferenze inutili per l'avversario. Si distingue così uno jus ad bellum, relativo al diritto di ricorrere alla forza, di cui il DICA si disinteressa, e uno jus in bello, il DICA per l'appunto, che regola i rapporti tra belligeranti durante il conflitto e che è destinato ad applicarsi a questi ultimi in modo imparziale, a prescindere, cioè, dalla legittimità o meno del ricorso alla forza da essi effettuato.
