Originariamente, il DICA è stato elaborato unicamente per i conflitti internazionali ovvero per i conflitti tra due o più Stati. Per questi conflitti, la regolamentazione è massima in quanto trova applicazione l'intero diritto dei conflitti armati. Il I Protocollo del 1977 ha equiparato ai conflitti internazionali i conflitti per l'autodeterminazione dei popoli, estendendo quindi a questi ultimi l'intero DICA grazie a una mera qualificazione giuridica. Non tutti gli Stati tuttavia sono parte di questo protocollo. Non ne sono parte, per esempio, gli Stati Uniti per i quali, quindi, i conflitti per l'autodeterminazione continuano a essere considerati interni.
